Question by Ella: Employment agencies using your credit report for a background check?
Hi!

In this day and age would they, and, do employment agencies use your credit report for background checks? What do they look for, if they do? What items would be considered negative strikes against you in consideration for employment? I am starting to go out to look for work. My credit report is so horrible since being laid off a year ago.

Thank you for your information in this matter!

Answer by Common Sense
Some employers do check credit, but it's different than a background check.

Using social media within recruiting agencies is fast, easy and free. In addition to going beyond traditional job boards, social media sites offer an uncensored peek into how job candidates act in uncensored moments. However, social recruiting challenges do exist. While it makes sense to leverage all publicly available information to screen job candidates, improperly using social media sites for screening purposes may lead to potential legal hot water with the Equal Employment Opportunity Commission (EEOC) or claims under the Fair Credit Reporting Act (FCRA). The biggest potential issues you need to concern yourself with are: discrimination, privacy and authenticity. Disparate impact: Does the use of social networks, although appearing neutral at face value, have an unintentional and unjustified adverse impact on members of a protected class? Identity: How do you know the profile you are viewing is actually your candidate? How certain are you that the content found on these sites is accurate? Relevancy: Are you able to ensure that all information found on these sites is job-relevant? To understand those issues in greater detail, consult with your legal counsel or screening provider. They'll be the first to tell you that you should consider whether the use of social media is really necessary as part of your screening process. Now, if you do go forward with using it, make sure you don't use it as your ONLY screening tool or do it last. Also obtain the consent of your ...

Question by Marc P: Are employment agencies justified in giving pay decreases due to the "economy"? How does the economy effect?
Due to workforce reductions, a bunch of us are getting an 8% pay decrease. This is because of the "economic climate". Don't these employment agencies make money regardless of the economy. The company I work for (through kelly services) pays kelly services, and then they pay us a percentage. How does the economy effect this??

Best answer:

Answer by Patricia C
I suspect they are getting fewer requests for workers and their income has dropped and that's why they're giving pay decreases.

Protecting Businesses With Employment Attorneys

Protecting Businesses With Employment Attorneys

Employment law in the 21st century is so complex that every business needs to have a good working relationship with a local employment attorney. It is this kind of partnership that protects a business from potentially catastrophic lawsuits. Many employment laws are in place to give business owners and managers the specific guidance and legal framework they need to make important decisions regarding employees or general employment policies. Employment attorneys help employers manage risks and control costs so that they can focus their time and resources on their businesses.

The Need for Employment Lawyers

While many businesses continue to operate under a common misconception - that they are too small to need an employment lawyer in today's more litigious business climate this misconception is more problematic than ever. Any company today that has employees needs to have legal counsel in order to stay informed and aware of laws pertaining to this specialized area. Every employer needs to understand the impact of such things as family or pregnancy leave, sexual harassment, wrongful termination, or how to apply the law when it comes to such seemingly routine things as lunch times or break times. A good employment attorney can assist in writing up policies that are created by the human resource department. Attorneys whose focus is employment and labor law, can advise clients in matters of employment discrimination, harassment, wrongful discharge, severance issues, and employment law compliance.

Employment Law and Proactive Management

Although that kind of employment lawyer participation in a business is easily affordable, it can potentially save a company tremendous amounts of money. When an employment lawyer is there to consult with management, legal communication between management and employees is improved. That kind of work environment can in turn, improve retention rates and performance and those factors contribute directly to a more robust bottom line. Human resource professionals also need input from employment lawyers to ensure that they are making decisions that are good for retaining and supporting employees, and these decisions are therefore good for the company as well. Otherwise companies open themselves up to potential legal problems related to everything from age or disability discrimination, or perceived wrongful termination, to disputes over overtime pay.

Selecting an Experienced Employment Attorney

When choosing an employment lawyer, it is important to first locate a law firm that has employment attorneys with verifiable credentials. When you meet with the prospective employment attorneys, ask them what kinds of cases they have handled, and what the outcomes were for the companies in each case. Ideally, the employment lawyer you choose will be experienced at providing legal advice at all stages of a problem situational and policy advice, litigation avoidance, and skilled representation in court and before administrative agencies.

Choose an employment attorney who not only has stellar credentials but also has a strong commitment to continuing education. Those reliable employment attorneys who have solid past experience combined with a forward-looking passion for the law will be able to serve their clients well, both now and in the future.

Has anyone had employment agencies not want to work with them anymore?

Question by Raines: Has anyone had employment agencies not want to work with them anymore?
Has anyone had that happen yet and if so, why did the employment agencies not want to work with you anymore?

Best answer:

Answer by Isabelle
Felony is one of the reasons. Convicted felons have limited rights relative to employment. Private employers and government agencies can inquire into a job applicant's criminal record, conduct criminal background checks and take information relative to a felony conviction into consideration. However, convicted felons do have a right to ensure that prospective employers follow Equal Employment Opportunity Commission guidelines in weighing the relationship between the conviction and necessary job qualifications.

Question by sweetnsassy: How do employment agencies work? I saw an add in the paper for a position through an agency.?
I went in and took a series of tests on the computer for typing, math, spelling, filing. They asked me a few questsions and I was told they would fax over my resume to the job opening I was interested in and call me if the employer was interested. Is this how all employment agencies work?

Best answer:

Answer by ebosgramma
That is pretty much how they work. They bring you in, take your info then expect you to call them every day to ask if they have any work for you. When they finally send you out on a job it could last anywhere from one day to a long term where the company may or may not eventually choose to offer you a job as an employee of the company rather working at their company as an employee of the agency.
It is a good way to get your foot in the door of some good companies but it also stinks if you need steady income and they only send you out on jobs that last a few days at a time with long times of not working in between.
Temp agencies normally do not offer benefits like paid holidays, vacation time and medical insurance if offered at all is usually very expensive.
